Eligibility, accounts, and acceptable use

You must be at least 18 years old and able to form a binding contract to use the service. The service is not directed to children.

The service is intended for users in the United States. Our content is organised around United States providers, United States pricing, and United States regulatory context.

We make no representation that the service or any content on it is appropriate, available, or lawful outside the United States. If you access the service from elsewhere, you do so on your own initiative and are responsible for complying with local law.

The operator, Varietly.com, is located in British Columbia, Canada. Directing the service to United States users does not make us a healthcare provider, pharmacy, prescriber, insurer, pharmacy benefit manager, or other licensed provider of services in any jurisdiction where that would require licensure.

The service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided personal information to us, contact us at info@varietly.com so we can take reasonable steps to delete it.

We may restrict, suspend, withdraw, or change the availability of the service in any jurisdiction at any time.

Nothing on the service is an offer to sell, supply, dispense, prescribe, arrange, or deliver medication anywhere. We provide information and referral links only.

At present, you cannot create a public user account on Varietly. The only user-facing registration feature is an email price alert subscription.

If you subscribe to price alerts, you must provide accurate information and you must own or be authorised to use the email address you submit. You may not subscribe another person without their permission.

By submitting your email address for a price alert, you consent to receive the alert emails you requested. Each alert email will include an unsubscribe link. If you unsubscribe, we will stop sending those alert emails to that address.

We intend to comply with the CAN-SPAM Act for commercial email. We do not currently offer SMS alerts. If we add SMS alerts, we will require express prior consent where required by the Telephone Consumer Protection Act and other applicable law.

We may stop, suspend, delete, or refuse an alert subscription at any time, including if we believe it is inaccurate, abusive, automated, unlawful, or harmful to the service or other users.

If and when we introduce user accounts, you will be responsible for keeping your credentials confidential and for all activity under your account. You must notify us promptly of any unauthorised use or suspected security incident involving your account.

You may use the service for ordinary personal reading and comparison. You may also quote limited figures with attribution to varietly.com, a link where practical, and the observation date shown on the page.

You must not do, attempt to do, or help anyone else do any of the following:

• scrape, crawl beyond ordinary search-engine indexing, spider, or automatically harvest pricing, provider, source, confidence-grade, or observation-history data;

• bulk extract, copy, cache, mirror, or systematically download the database or any substantial part of it;

• resell, sublicense, publish, syndicate, or commercially redistribute our data or any substantial part of it;

• reverse engineer, decompile, disassemble, or attempt to derive source code, non-public data structures, or non-public methods from the service;

• circumvent rate limits, access controls, robots directives, authentication systems, or other technical protection measures;

• attempt to access the password-protected staff admin area or any other non-public system, or perform credential stuffing, probing, scanning, or penetration testing without our written permission;

• introduce malware, interfere with the service, launch a denial-of-service attack, or impose an unreasonable or disproportionate load on our systems;

• use the service to violate law, infringe rights, harass anyone, deceive anyone, or collect information about another person without lawful authority;

• misrepresent our data as a provider’s own data or present our figures as current without showing the observation date displayed on the page; or

• use our data to train, fine-tune, evaluate, enrich, or validate a machine-learning model, or to build a competing pricing dataset, without our written permission.

The machine-learning and competing-dataset restrictions in section 11.2 are contractual use restrictions. They apply whether or not individual price figures are independently factual.

We may rate-limit, block, suspend, or terminate access to the service if we believe you have violated these Terms or created risk for the service, our users, providers, or us. We may also pursue any remedies available under law or equity.

We do not currently offer public user reviews or public comments. If and when we offer correction reports, provider feedback, reviews, comments, or other submission features, anything you submit through those features is your user content.

You grant us a worldwide, non-exclusive, royalty-free, sublicensable, transferable, perpetual, and irrevocable licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, display, distribute, and otherwise exploit your user content in connection with operating, improving, promoting, and providing the service.

To the extent permitted by law, you waive and agree not to assert any moral rights, droit moral, rights of integrity, rights of attribution, or similar rights you may have in user content against us, our service providers, successors, assignees, sublicensees, and users.

You represent that you own or have all rights needed to submit your user content and to grant the licence in these Terms. You also represent that, to your knowledge, your user content is accurate, does not infringe anyone’s rights, and is not defamatory, deceptive, unlawful, or harmful.

You must not submit clinical advice, treatment recommendations, dosing guidance, or claims about any medication’s safety, efficacy, suitability, or expected health outcome. User content must not tell another person to start, stop, or change any medication or treatment.

You should not submit personal health information, medical records, prescription details, diagnoses, symptoms, insurance identifiers, or other sensitive information. If you submit user content, you understand that it may be published or otherwise used as described in these Terms.

We may remove, edit, decline, reformat, or refuse to publish user content at any time and for any reason. We are not obligated to monitor user content, and any moderation we choose to perform does not make us the author, speaker, publisher, or endorser of a user’s statements.

User content is not confidential. You will not receive compensation, reimbursement, credit, or other payment for submitting it unless we separately agree in writing.

The service, including its design, layout, text, editorial analysis, source annotations, confidence grades, observation history, and the selection, coordination, normalisation, verification, and arrangement of the provider pricing database, is owned by us or our licensors and is protected by copyright, trademark, trade secret, database, unfair-competition, contract, and other laws.

Individual factual prices are facts, and these Terms do not claim ownership of raw facts that exist independently of the service. We do claim rights in our original expression, editorial analysis, and the protected compilation, selection, normalisation, verification, source trail, confidence grading, observation history, and arrangement of those facts.

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use the service for your personal, non-commercial purposes.

You may not use the Varietly name, logo, wordmark, trade dress, or other brand elements without our prior written permission, except as allowed by law.

Third-party trademarks, including Ozempic®, Wegovy®, Mounjaro®, Zepbound®, provider names, and provider logos, belong to their respective owners. We use them only to identify the relevant medications, providers, or services. That use does not imply affiliation, sponsorship, approval, or endorsement.

You may quote limited pricing figures from the service if you attribute them to varietly.com, include a link where practical, and include the observation date shown with the figure. This permission is limited, revocable, and subject to the acceptable-use restrictions in section 11.

If you believe content on the service infringes your copyright, send a DMCA-style notice to info@varietly.com. Your notice should identify the copyrighted work, identify the allegedly infringing material and its location, include your contact information, state that you have a good-faith belief the use is not authorised, state that the information in your notice is accurate, and include your physical or electronic signature.
